These terms are the agreement between you and Alivey. By using the app you accept them. If you do not, please do not use Alivey.
You must be at least 13 years old. If you are under the age of majority where you live, you may only use Alivey with the involvement of a parent or guardian, who accepts these terms on your behalf.
You photograph a real plush toy. We run an automated safety check, generate a 3D character from the photo, and give you a companion you can talk to by voice or text. The character is generated by AI.
Your character is an AI. It is not a person, and it is not an expert. It will sometimes say things that are wrong, odd, or made up. Do not rely on it for medical, legal, financial, safety or any other professional advice.
It is not a crisis service. If you or someone else is in danger or in distress, contact your local emergency number or a crisis line. Alivey cannot help and is not monitored by a human.
You keep ownership of the photos you upload. By uploading one you give us permission to process it for the purpose of running the safety check and generating your character — nothing else. We do not use your photos to train AI models, and we do not use them in marketing without asking you first.
You must have the right to photograph what you photograph. Please do not upload photos of other people, and only upload pictures of toys you own.
You may use the character you generate for personal, non-commercial purposes.

Alivey is free to start, with a limited allowance of talking time and one character. Alivey Plus is an auto-renewing subscription that raises both. Exact prices, allowances and billing periods are shown in the app before you buy, in your local currency.
Purchases are handled by Apple and Google, so refunds are theirs to grant — request one through the store you bought from. If you are in the EU or UK, your statutory rights of withdrawal are unaffected. If something went wrong on our side, email jakob@alivey.ai and we will help you pursue it.
We may change prices or allowances. Changes never apply to a period you have already paid for, and you will be told before a renewal at a new price.
We try to keep Alivey running, but we do not promise it will always be available or error-free. Features may change or be removed. Character generation depends on third-party AI services and can fail; if a generation fails, it does not consume your allowance.
You can stop at any time: delete your data in Profile, and uninstall. We may suspend or end your access if you break these terms, or if we discontinue the service — in which case we will give reasonable notice and refund any unused prepaid subscription time where the law requires it.
Alivey is provided "as is", to the fullest extent the law allows. We are not liable for indirect or consequential loss. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or EUR 50. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited — and if you are a consumer, your mandatory statutory rights are unaffected.
We may update these terms. The date at the top changes, and for significant changes we will tell you in the app before they take effect. Continuing to use Alivey after that means you accept the new terms.
These terms are governed by the laws of Slovenia, and the courts of Slovenia have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country you live in, and may bring proceedings there.
